Der Klimawandel ist eines der Themen, die die politischen und rechtlichen Diskussionen auf internationaler Ebene seit geraumer Zeit beherrschen. In dieser Arbeit werden seine Auswirkungen auf die wohl am stärksten Betroffenen untersucht. Einige kleine Inselstaaten haben nicht nur mit wirtschaftlichen, sondern insbesondere aufgrund des möglichen Verlusts des gesamten Staatsgebiets mit erheblichen nichtwirtschaftlichen Risiken zu kämpfen. Der Autor behandelt in einem ganzheitlichen Ansatz verschiedene rechtliche Fragen, die sich angesichts dieses beispiellosen Phänomens ergeben. Beleuchtet werden Implikationen des Flüchtlingsvölkerrechts, des Seerechts, Auswirkungen auf die Staatlichkeit, sowie die völkerrechtliche Verantwortlichkeit von Industriestaaten. Die Arbeit zeigt, dass alle adressierten Problemfelder miteinander in Verbindung stehen und sich gegenseitig beeinflussen und ihre konkrete politische und rechtliche Behandlung daher die Würdigung all dieser Aspekte erfordert.

Providing a much-needed study on cybersecurity regime building, this comprehensive book is a detailed analysis of cybersecurity norm-making processes and country positions, through the lens of multi-stakeholder diplomacy. Multidisciplinary and multinational scholars and practitioners use insights drawn from high-level discussion groups to provide a rigorous analysis of how major cyber powers view multi-stakeholder diplomacy.

Looking at how past cybersecurity initiatives and multi-stakeholder negotiations in other fields illuminate its dynamics, this book will help put states' approaches towards multi-stakeholder cyber diplomacy into perspective, and frame the role of private actors in cybersecurity regime building. Evaluating the most promising institutional arrangements and mechanisms for implementing cybersecurity, this book combines top-down analyses relevant to the design of international cybersecurity regimes with bottom-up case studies, tracing the approaches of important states towards multi-stakeholder participation in cyber diplomacy.

Nach mehr als zwanzig Jahren hat das zunächst als »Papiertiger« belächelte Völkerstrafgesetzbuch inzwischen seinen festen Platz in der deutschen Strafrechtspraxis. Auf dieser Grundlage befasst sich die deutsche Justiz unter anderem mit Staatsfolter in Syrien, dem Völkermord an den Jesid:innen und Kriegsverbrechen im Ukraine-Konflikt. Diese Verfahren stellen die beteiligten Institutionen vor zahlreiche Herausforderungen, die den meisten »regulären« nationalen Strafprozessen fremd und im Wesentlichen darauf zurückführen sind, dass zwischen Justiz und abzuurteilenden Taten eine große örtliche, kulturelle und ggf. zeitliche Distanz besteht. Der Sammelband führt Beiträge von Wissenschaftler:innen aus verschiedenen Disziplinen und Vertreter:innen aus allen Bereichen der Justizpraxis zusammen, die diese Herausforderungen aus ihren jeweiligen Perspektiven analysieren. Damit wird der Grundstock für eine empirisch und wissenschaftlich fundierte Weiterentwicklung des nationalen Völkerstrafprozessrechts gelegt.
