War devastates the lives of those who are caught up in it. For thousands of years, reparations have been used to secure the end of war and alleviate its deleterious consequences. More recently, human rights law has established that victims have a right to reparations. Yet, in the face of conflicts that last for decades with millions of victims, how feasible are reparations? And what are the obstacles to delivering them?
Using interviews with hundreds of victims, ex-combatants, government officials, and civil society actors from six post-conflict countries, Reparations and War examines the history, theoretical justifications, and practical challenges of implementing reparations after war. It examines the role of non-state armed groups in making reparations, the role of victim mobilisation, the evolving use of reparations, and the political instrumentalization of redress.
Luke Moffett offers a measured and honest account of what reparations can and cannot do. This book sheds new light on how reparations can be politically manipulated, or used to reward those loyal to the State, rather than to achieve justice for the victims who suffer.

Reparations for Slavery in International Law examines the case for contemporary redress for the harms and legacies of transatlantic enslavement from a legal perspective. The book critically evaluates the history of transatlantic enslavement as well as the evolutions in international law that justified and perpetuated the exploitation of African peoples and people of African descent. It offers an analysis of the requirements of state responsibility, assessing the impact of time on claims for redress for historic injustices. A new theory of reparatory justice is proposed, which is responsive to both the underpinning principles and the modalities of redress in international law. This book considers the emerging practice of reparations in transitional justice and the relevance of these frameworks in cases of widespread historic injustice, while upending orthodox understandings of the international legal frameworks relevant to case for reparations. In so doing, it opens new space for the reconsideration not only of the international legal claim for reparations for slavery, but also the moral and political case.

Le fait illicite de l’État – la violation du droit international qui lui est attribuable – engage sa responsabilité internationale. Celle-ci donne naissance à un ensemble de relations juridiques nouvelles. L’une d’entre elles, traditionnelle mais restée primordiale dans le paysage des réclamations internationales, impose à l’État responsable le devoir de réparer intégralement le préjudice causé. Cette obligation, qui prend le plus couramment la forme d’une indemnisation, est conditionnée par l’existence d’un lien de causalité suffisant entre le dommage et le fait générateur. Or, derrière une idée simple, la notion de causalité interroge. En témoigne la pratique des juridictions internationales, qui demeure floue et inconstante, ce qui contribua à la décision de la Commission du droit international, lors de ses travaux de codification sur le sujet ayant abouti en 2001, de ne pas véritablement la définir. Pourtant, au-delà de ces apparentes disparités, il reste possible – et souhaitable, compte tenu de l’enjeu pratique qu’elle présente – d’en préciser le contenu. Tel est l’objet et l’ambition de cette monographie.

Die Opfer internationaler Straftaten haben schwerstes physisches und psychisches Leid erfahren. Mit Recht fordern sie auch noch nach Jahrzehnten Reparationen für die erlittenen Schäden und schweren Menschenrechtsverletzungen. Die Autorin weist in ihrer interdisziplinären Studie, welche Erkenntnisse der Philosophie, Rechtswissenschaft und Politikwissenschaft einbezieht, nach, dass der Anspruch der Opfer auf Reparationen menschenrechtlich fundiert ist. Insoweit erweist sich die Anerkennung von Opferwerdung und Opfersein als Voraussetzung des Menschenrechts auf Reparationen und sein gerechtigkeitsschaffendes Prinzip. Zugleich verklammert die Autorin diese Grundsatzreflexionen mit einer konkreten institutionellen Problembeschreibung der Reparationspraxis am Trust Fund for Victims des Internationalen Strafgerichtshofs. Dabei legt sie die Defizite der Operationalisierung des Menschenrechts auf Reparationen am IStGH schonungslos offen.

Seit der Errichtung des Internationalen Strafgerichtshofs wurde sein Mandat wiederholt mit der Schaffung von Opfergerechtigkeit, »justice for victims«, beschrieben. Maßgeblicher Teil dessen ist die Anordnung von Opferentschädigung gegen die vom IStGH verurteilten Täter. Der Internationale Strafgerichtshof hat nunmehr drei Reparationsentscheidungen gefällt. Es zeigt sich, dass Wiedergutmachung im Bereich der Makrokriminalität nicht trivial ist. Unterschiedliche rechtliche Verständnisse und Ansätze können zu sehr unterschiedlichen Rechtauffassungen führen. Die vorliegende Arbeit beschäftigt sich mit dem Reparationsregime des IStGH. Ausgehend von allgemeinen Gedanken zum Ziel und Zweck des Reparationsregimes, werden die Anspruchsvoraussetzungen des Art. 75 IStGH-Statuts analysiert, in der Konturierung, die die Tatbestandsvoraussetzungen durch die Entscheidungen Lubanga, Katanga und Al Mahdi erhalten haben.

Victim Reparation under the Ius Post Bellum fills an enormous gap in international legal scholarship. It questions the paradigmatic shift of rights to reparation towards a morality-based theory of international law. At a time when international law has a tendency to take a purely positivistic and international approach, Shavana Musa questions whether an embrace of an evaluative approach alongside the politics of war and peace is more practical and effective for war victims. Musa provides a never-before-conducted contextual insight into how the issue has been handled historically, analysing case studies from major wars from the seventeenth century to the modern day. She uses as-yet untouched archival documentation from these periods, which uncovers unique data and information on international peacemaking, and actually demonstrates more effective practices of reparation provisions compared with today. This book combines historical analysis with modern day developments to provide normative assertions for a future reparation system.
